Enduring Fruits provides website design, hosting, domain registration, and related services, as described in our Service Agreement. Access to our Services is subject to these Terms, our Privacy Policy, and any other policies posted on our Site.
2. Intellectual Property
All rights, titles, and interests in our designs, content, and materials remain with Enduring Fruits or our licensors until full payment is received. Upon completion and full payment, ownership of the final website design, structure, custom content (excluding unpaid third-party content), and domain name transfers to the client, as outlined in the Service Agreement.
You acknowledge that our work may incorporate third-party content (e.g., Canva graphics, stock images) licensed for use but not owned outright, and that Enduring Fruits is not responsible for any copyright claims arising from such materials.
3. Third-Party Services
Our Services may involve the use of third-party products, software, hosting providers, or applications. We are not responsible for the content, functionality, or performance of third-party services, and your use of such services is at your own risk.
4. Accounts
To access certain Services, you may need to create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity under your account.
- Immediately notifying us of any unauthorized access.
We are not liable for any loss or damage arising from your failure to safeguard your account information.
5. Termination
We may suspend or terminate your access to our Services at any time, with or without cause or notice, if we believe you have violated these Terms or engaged in prohibited activity.
You may terminate your account or discontinue services at any time by contacting us. Termination does not affect any payment obligations already incurred.
6. Refunds
Refunds are subject to our Service Agreement:
- Domain Names: Nonrefundable once purchased or claimed.
- Hosting: Refundable solely for the unused portion of the current month.
- Other Services: As outlined in the Service Agreement.
7. Disclaimer of Warranties
Our Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied. We do not warrant that our Services will be uninterrupted, error-free, or secure. You use our Services at your own discretion and risk.
8. Limitation of Liability
To the fullest extent permitted by law, Enduring Fruits will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services, including loss of data, profits, or business opportunities.
9. Jurisdiction & Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State of California. Any disputes will be resolved in the state or federal courts located in California.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. If changes are material, we will notify you by posting the updates on our Site and/or sending you an email before they take effect. Continued use of our Services after changes are effective constitutes acceptance of the new Terms.
