Digital Millennium Copyright Act (DMCA) Notice & Procedure

Enduring Fruits (“we,” “our,” or “us”) respects the intellectual property rights of others, just as we expect others to respect ours. Pursuant to the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their authorized agents may submit a takedown notice to our DMCA Agent as outlined below.
As a website service provider, we are entitled to claim immunity from infringement claims under the DMCA’s “safe harbor” provisions. To submit a valid infringement claim, you must provide a written notice including the following information:
Notice of Infringement – Requirements

A physical or electronic signature of the copyright owner or authorized representative.

Identification of the copyrighted work claimed to have been infringed.

Identification of the infringing material to be removed, including sufficient information to locate the material (e.g., the specific URL).

Contact information for the complaining party, including name, physical address, email, and phone number.

A statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
⚠ Note: Under Title 17 USC §512(f), any person who knowingly misrepresents that material or activity is infringing may be liable for damages, including costs and attorney’s fees.
How to Submit a DMCA Notice

By submitting a claim, you acknowledge that we may share your identity and details of your claim with the alleged infringer.
Counter Notification – Restoration of Material
If you have received a DMCA takedown notice and believe the material was removed in error or due to misidentification, you may submit a counter notification containing:

Your physical or electronic signature.

A description of the removed material and its original location.

A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.

Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court where you reside (or any U.S. district court if outside the U.S.), and that you will accept service of process from the person who submitted the original DMCA claim.

Repeat Infringer Policy
We maintain a record of DMCA notices and will terminate accounts of repeat infringers in accordance with the DMCA.
